Jharkhand Governor C P Radhakrishnan has returned the Jharkhand Reservation of Vacancies in Posts and Services (Amendment) Bill, 2022 to the government, asking for a review, it is learnt.

The Bill had proposed to raise reservation in state government jobs from 60% to 77% for people belonging to Schedule Tribes (ST), Schedule Castes (SC), Other Backward Classes (OBC) and those from the Economically Weaker Sections (EWS).

The Bill had sought to increase OBC quota from 14% to 27%; ST quota from 26% to 28%; reservation for SC from 10% to 12%. Along with this, the 10% EWS quota (existing) would have taken total reservation in state government jobs to 77%.

A source in the Governor’s office said the Bill was returned after an opinion was sought from the Attorney General of India. “Former Governor Ramesh Bais had sent the Bill to the Attorney General for (obtaining) legal point of view. Certain objections were raised and the Bill was sent back for review to the state government last month. The government has not responded until April 19,” the source said.

People from OBC and ST communities constitute more than 65% of Jharkhand’s population. Sources said the reservation would apply to government jobs, and not to admissions in government-run universities or colleges.

In November, after the Bill was passed in the Assembly, Chief Minister Hemant Soren had said that it would come into force only after the Centre carried out amendments to include it in the Ninth Schedule, putting it beyond judicial scrutiny.
